This policy explains how Blue Element Freediving Inc. — a company incorporated in the Commonwealth of Dominica, operating from Soufrière Bay, Dominica (“Blue Element”, “we”, “us”) — collects, uses and protects your personal data. We are the data controller. Because we welcome athletes and guests from the UK, EU and beyond, we aim to handle personal data in line with the EU and UK General Data Protection Regulation (GDPR) where it applies, as well as applicable Dominican law.

1. What we collect

• Contact details — your name, email address, phone/WhatsApp number and country, when you enquire, register interest, join our mailing list or make a booking.
• Freediver profile — for competitions, training and camps: your discipline(s), certification body and level, personal-best and target depths, competition history, and whether you require safety support.
• Health & safety information — a medical questionnaire, fitness-to-dive information, insurance details and an emergency contact, collected as part of booking and the liability release. This is special-category data and we treat it with particular care.
• Booking & travel details — the product you booked, dates, arrival/flight information and any equipment or accommodation needs you share with us.
• Payment information — payments are processed by Stripe. We receive confirmation and basic transaction details; we never see or store your full card number.
• Usage data — if analytics are enabled, limited information about how you use this website (see Cookies & analytics below).

2. Why we use it

• To respond to your enquiries and send you the information you ask for (course, camp and competition packs).
• To take bookings and payments, run your course, training, camp or competition entry, and keep you safe in the water.
• To send you booking confirmations, onboarding details, waivers and pre-arrival information.
• To send you news and offers if you have asked to hear from us.
• To meet our legal, insurance and event-sanctioning obligations.

3. Legal bases

• Contract — to deliver a booking you have made or asked us to arrange.
• Consent — for marketing emails, and for handling health information; you can withdraw consent at any time.
• Legitimate interests — to answer enquiries, run and improve our business, and keep our services and community safe, where this does not override your rights.
• Legal obligation — where we must keep records or share information to comply with the law or a sanctioning body.

4. Who we share it with

We do not sell your data. We share it only with trusted providers who help us operate, and only as needed:

• Stripe — to process card payments.
• Our email provider (e.g. MailerLite) — to send the mailing list and booking communications you have opted into.
• Analytics providers — if enabled, to understand website usage in aggregate.
• Sanctioning bodies (AIDA, CMAS) — competition entry and results information, where you enter one of our events.
• Medical & safety personnel — relevant health information in an emergency, or as needed to keep you safe.
• Where required by law, or to establish, exercise or defend legal claims.

5. Cookies & analytics

This site uses only what it needs to function. If and when we enable website analytics, it will be limited to understanding how visitors use the site (pages viewed, rough location, device) so we can improve it — not to track you across other websites. This policy will name the provider once it is live, and where required we will ask for your consent.

7. How long we keep it

We keep your data only as long as we need it: for the life of your booking and our relationship, and afterwards where we must for legal, tax, insurance or safety reasons. Mailing-list data is kept until you unsubscribe or ask us to remove it. Health information is kept only as long as necessary for the activity and any legal requirement, then deleted.

8. International transfers

We operate from Dominica and use service providers based in other countries, including the US and EU. Where your data is transferred internationally, we take reasonable steps so it remains protected to a standard consistent with this policy.

9. Your rights

Depending on where you live, you may have the right to access the data we hold about you, correct it, delete it, object to or restrict how we use it, withdraw consent, and receive a copy in a portable form. To exercise any of these, email us and we will respond within a reasonable time. You also have the right to complain to your local data-protection authority.

10. Security

We use appropriate technical and organisational measures to protect your data, and we work with providers (such as Stripe) who maintain their own strong security. No system is perfectly secure, but we take reasonable care and will tell you and the relevant authorities of a breach where the law requires.

11. Children

Our services are aimed at adults. Participants under 18 require written consent from a parent or guardian, and we only collect a minor's data with that consent and for the activity booked.
